Learned counsel appearing on behalf of the petitioner submits that apart from the statement of a co-accused, which is inadmissible in evidence, there is no other material available against the present petitioner.
Learned counsel appearing on behalf of the State files a report, which is taken on record. He opposes the prayer for anticipatory bail and submits that as per the statement of a co-accused, the petitioner was there at the spot, but fled away. Besides other materials, there is a criminal antecedent of the petitioner involving offences under the NDPS Act.
Considering the above and the fact that the petitioner has a criminal antecedent involving offences under the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected.
Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
