Petitioner is directed to serve a copy of the revisional application upon Ms. Ayantika Roy, learned advocate who usually appears on behalf of the State. Her appearance may be regularized by the concerned authorities in due course.

Learned advocate for the petitioner submits that his limited prayer is that the protest petition till date has not been disposed of although the same is pending for a considerable period of time. Learned advocate submits that the availability of the case diary and the Investigating Officer are solely responsible for such delay. It has been submitted that the next date has been fixed on 20th February, 2024. Accordingly, learned C. J. M, Alipore is directed to dispose of the application under Section 173(8) of the Code of Criminal Procedure on the said date, if the same is beyond the control of the learned CJM, Alipore at least by 27th February, 2024, the said application under Section 173(8) Cr.PC should be disposed of. The timeline at any cost should not be stretched further. With the aforesaid observations, the revisional application being CRR 4747 of 2023 is disposed of.
