1. The grievance of the petitioner is directed against the alleged refusal of the respondent WBSEDCL to restore the electricity connection to the premises of the petitioner. The petitioner also complains of non-consideration of his representations dated 8th January, 2025 and 31st January, 2025 respectively.

2. Pursuant to a direction dated 27th January, 2026 the WBSEDCL was directed to file a Report dealing with the grievance of the petitioner. The Report dated 22nd February, 2026 is filed in Court. The same is circulated to all the parties. It appears from the said Report that though there was a dispute in respect of a provisional assessment

amount of Rs.1,69,132/- which had also culminated in a criminal case being filed under Section 135 of the Act, the said amount has been paid in three installments. This is an admitted position by the WBSEDCL which is also accepted by the petitioner. However, on account of outstanding dues an amount of Rs.1,63,886.85/- along with assessed LPSC amount of Rs.66,224/- remains outstanding till date. In view of the above admitted position the petitioner is attempting to confuse the issue by showing payments made on account of the provisional assessment bill for the period 15th March, 2022 to 14th March, 2023.

3. In such circumstances, the entire case made by the petitioner is false and misleading. The admitted position remains that an aggregate amount of close to approximately Rs.2,32,000/- continues to remain outstanding.

The WBSEDCL alleges that the petitioner is in the business of selling electricity and this submission is disputed by the petitioner.

4. In view of having approached this Court with unclean hands and the amount which is due and payable to the WBSEDCL remaining outstanding, there is no scope of passing any order in favour of the writ petitioner.

5. The writ petition being WPA/28758/2025 stands dismissed.

6. There shall be no order as to costs.
