1. By this application, the petitioner seeks expeditious disposal of the Title Suit (Com) No.85 of 2024 along with a pending application, which are pending before the learned Judge, Commercial Court at Alipore.

2. Considering the submissions, the Court is of the view that the prayer of the petitioner is innocuous. Neither party stands to lose if a proceeding is disposed of expeditiously. In fact, such expeditious disposal shall enure to the benefit of the parties. Hence, there is no requirement for service of prior notice upon the opposite parties.

3. The revisional application is disposed of with a direction upon the learned court to dispose of the application within a month from the next date fixed and based on the consequences of the said application, the suit shall be disposed of expeditiously, preferably within a period of one year. Adequate opportunity shall be given to the parties to contest the same.

4. This court has neither expressed any opinion on the merits of the application nor on the merits of the suit.

The learned court shall proceed independently and in accordance with law.

5. A copy of this revisional application along with a copy of this order be served upon the opposite parties as also upon the learned advocate appearing on behalf of the opposite parties in the learned trial court.

6. The revisional application is accordingly disposed of.

7. There shall be no order as to costs.

8. Parties are to act on the server copy of this order. (Shampa Sarkar, J.)
