The State of West Bengal and others Ms. Purnima Ghosh ... for the petitioner The petitioner submits that her name appeared at serial no.2 in a document dated February 20, 2019. The petitioner was allegedly recommended for engagement as Anganwadi Helper in ICDS centre No. AG217, under Ranaghat-II Block.

The petitioner contends that on the recommendation of the Member of Legislative Assembly, Government of West Bengal, addressed to the Minister-in-Charge, Government of West Bengal, similarly situated candidates had been engaged. The petitioner prays for similar consideration and also for remuneration.

The Court has not found that a recruitment process or a process for engagement of Anganwadi Helpers, had been initiated. It is also not on record whether the petitioner had participated in any selection process. The petitioner solely relies on a recommendation of a Member of the Legislative Assembly.

The writ court is not in a position to pass any orders. Thus, the writ petition is disposed of with

liberty to the petitioner to approach the Child Development Project Officer, Ranaghat Block-II, ICDS Project, for intimation as to the fate of her engagement as Anganwadi Helper under the alleged Home Quota.

Further prayer can be made for remuneration as it is contended that the petitioner has been working since 2010 without any remuneration.

However, if the engagement of the petitioner was a personal arrangement and not as per rules, the state exchequer cannot be burdened.

Considering all the documents and the prayer and upon hearing the petitioner, a reasoned order shall be passed and communicated to the petitioner by the Child Development Project Officer. The entire exercise must be completed within two months from receipt of the petitioner's communication.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of server copy of this order as well as on the basis of communication of the learned advocates.
