No. 29 gd/ssd C.R.M.(A) 5492 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Kaliganj Police Station Case No. 468 of 2023 dated 21.07.2023 under Sections 448/376(3)/325/34 of the Indian penal Code and Section 4 of the POCSO Act.

...... petitioner Mr. Mizanur Rahamn ....for the petitioner Ms. Subhasree Patel ....for the State Police are proceeding under Section 376(3) of the Indian Penal Code, 1860.

Victim recorded as statement under Section 164 of the Criminal Procedure Code and claimed that she was 16 years of age. She also claimed that she was raped at gun point bythe petitioner.

In such circumstances, we are not minded to grant anticipatory bail to the petitioner.

This application for anticipatory bail is, thus, rejected as not maintainable.
