This is an application praying for a direction upon the learned Judge, 3rd Bench, City Civil Court at Calcutta to dispose of the application under Order 7 Rule 11 of the Code of Civil Procedure filed by the petitioner herein in Title Suit No.2366 of 2023. Record reveals that the opposite parties herein have also filed the written objection against the application under Order 7 Rule 11 of the Code of Civil Procedure.

From the order-sheets annexed to the civil revision application it is evident that 19th December, 2024 was fixed for hearing of the application under Order 7 Rule 11 of the Code of Civil Procedure. The learned Advocate appearing for the petitioner submits that on that date the hearing of the application under Order 7 Rule 11 of the Code of Civil Procedure was adjourned and the next date has been fixed on 21st February, 2025.

In view thereof, CO 4168 of 2024 is disposed of by requesting the learned Judge, 3rd Bench, City Civil Court at Calcutta to take up the hearing of the application under Order 7 Rule 11 of the Code of Civil Procedure on the next date fixed and to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

There will be no order as to costs.

Urgent certified copy of this order, if applied for, be given to the learned advocates for the parties on usual formalities.
