Affidavit of service filed by the petitioners and the report submitted by the State are taken on record. Learned counsel for the petitioners submits that the petitioners are the owners of the land in question and are being resisted from entering the same by the private respondents who are rank outsiders. The petitioners lodged a complaint before the police authority which has not been considered.

Learned counsel for the private respondents denies and disputes the allegations made by the petitioners and submits that the private respondents were not present in or around the place of occurrence at the relevant time and has no nexus with the alleged incident.

It appears from the report submitted by the State that pursuant to the complaint lodged by the petitioners, a preliminary enquiry was held and it was found that the contents of the said complaint were false and fabricated. The claim of the petitioners was not supported in course of

enquiry. The report also indicates that the local villagers organise a fair in the said land every year for the last sixty years upon taking permission from the land owners and such permission was not granted by the petitioners this year.

The petitioners seek to submit a comprehensive representation before the police authority ventilating their grievance. In the event such representation is submitted, the police authority shall take necessary steps in accordance with law.

Since no fruitful purpose shall be served by keeping the writ petition pending, the same is accordingly disposed of.

There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
