Petitioner before us is named by the eye-witness recording statement under Section 164 of the Code of Criminal Procedure to be a participant in the murder.

Considering the materials in the case diary, the gravity of the offence and the involvement of the petitioner therein, we are unable to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.

C.R.M. (A) 5501 of 2023 is dismissed.
