The writ application has been preferred challenging the grant of licence in favour of the private respondent no. 9.

Exception to the report filed by the State is filed.

In course of hearing the learned counsel for the petitioner submits that his grievance will be addressed if the authority concerned is directed to consider his representation dated 28.11.2023 (Annexure P 6).

On hearing the learned counsels for the parties and on perusal of the materials on record the writ application is disposed of with the direction that the respondent no. 5 the District Controller Food & Supplies, Uttar Dinajpur, shall consider the said representation dated 28.11.2023 (Annexure P 6), within 60 days from the date of communication of this order, on hearing the parties, by passing a reasoned order in accordance with law.

This Court has not gone into the merits of the case and the case as made out in the writ petition is not admitted by the respondents.

The Writ application stands disposed of.

Applications, if any, connected thereto stand disposed of consequently.

Interim order, if any, stands vacated.
