Statement of eyewitnesses recorded under Section 164 of the Criminal Procedure Code ascribed active role to the petitioner before us. It is said by such eyewitnesses that the petitioner participated in dealing blows on the deceased by sharp cutting weapon.

Considering the gravity of the offence and the involvement of the petitioner transpiring from the materials in the case diary, we are unable to grant anticipatory bail to the petitioner. This application for anticipatory bail is, thus, rejected. (Debangsu Basak, J.) (Md. Shabbar Rashidi, J.)
