Pursuant to the orders dated November 26, 2021 and December 3, 2021 the writ petition appears today. An affidavit of service is filed in Court, taken on record.

The grievance of the writ petitioners was that in 2007 the Nalpur Gram Panchayat had encroached a portion of the land of the writ petitioners for construction of road. On December 17, 2007 a coordinate Bench was pleased to pass an interim order to the effect that the parties to the proceeding shall not change the nature and character of the Plot No.641 without obtaining leave of this Court. Such interim order was extended and was directed to remain in force till disposal of the writ petition by an order of another coordinate Bench dated January 29, 2008. Subsequently, the writ petition was dismissed on the ground of default on March 10, 2010 and the same was restored on December 24, 2010.

Despite notice none appears for the respondents nor any accommodation has been sought for even today.

Considering the submissions made on behalf of the writ petitioners and upon due perusal of the records of the proceeding, the interim order passed in the writ petition on December 17, 2007 which was directed to continue till disposal of the writ petition on January 29, 2008 stands confirmed and the writ petition being WPA 26580 of 2007 stands disposed of.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
