Learned advocate appearing for the petitioner submits that the petitioner has been arraigned in connection with the instant case and detained in custody for about a year for alleged recovery is of 25.841 kg of ganja. Charges have been framed in connection with the instant case but the witness action has not been started. Petitioner prays for bail on any stringent conditions.

Learned advocate for the State opposes the prayer for bail and submits that there were specific accusations so far as the present petitioner is concerned.

I have taken into account the period of detention of the present petitioner and the quantum of seizure and I am of the view that further detention is unwarranted. Accordingly, the prayer for bail of the petitioner is allowed.

As such, petitioner namely, Durgesh Singh shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court under NDPS Act cum Learned Additional Sessions Judge, 3rd Court, Asansol, Paschim Bardhaman.

If on bail, the petitioner shall be physically present on each and every date before the learned trial Court in seisin of the case. The petitioner shall not leave the jurisdiction of district of Paschim Bardhaman without the prior permission of the learned Special Court.

Accordingly, the application for bail being CRM (NDPS) No. 1667 of 2025 is allowed.
