A direction to secure expeditious disposal of Title Suit being Title Suit No. 34 of 2011 pending before the learned Civil Judge (Junior Division), 7th Court, Howrah, is the ultimate relief sought for in this case. The only contention expressed by the petitioner is against the delay caused in the disposal of the suit, for the adjournment being granted on as many as 16 occasions without any justified reasons.

Attention of the Court is drawn to order dated 12th December, 2019 passed in C.O. 4553 of 2015, wherein there has been a direction requiring the court below to ensure expeditious disposal of the suit within a period of six month from the date of communication of this order.

It is submitted by Mr. Mukherjee that till such date, the logical conclusion of the suit has not yet reached.

In view of the nature of the order proposed to be made in the case, no prior notice is considered to be

necessary.

Service upon the opposite party is thus dispensed with.

When there is already a direction requiring to ensure expeditious disposal of the suit, no further direction is called for.

The revisional application stands disposed of reposing trust and confidence upon the court below that the logical conclusion of the suit may be reached with utmost expedition upon sensing the message already conveyed in C.O. 4553 of 2015, preferably before the end of Summer Vacation of the Court below. Petitioner is directed to make communication of this order to the learned court below.

With this observation and direction, the revisional application stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
