CAN 2 of 2021 is disposed of by taking up the writ petition for consideration.

By this writ petition, the petitioner complains that an application under Section 9 of the Bengal Public Demands Recovery Act, 1913 was not decided by the Authority. State is represented.

It appears that, the certificate proceedings were initiated against the petitioner under the Act of 1913. The petitioner as the Certificate Debtor applied under Section 9 of the Act of 1913 claiming that he is not liable. Such petition is yet to be decided.

In such circumstances, it would be appropriate to direct the Certificate Officer to decide the application made

by the petitioner under Section 9 of the Act of 1913 within a period of fortnight from the date of communication of this order.

WPA 23938 of 2009 is disposed of accordingly without any order as to costs.
