.....For the Petitioner Mr. M. Sur Mr. M. Mahata .....For the State Petitioner apprehends that he may be taken into custody in case he appears in connection with Sessions Case No.71/22 as warrant of arrest has been issued by the learned Sessions Judge, Malda. Records reflect that earlier petitioner was granted bail and for reasons beyond his control on and from 08.04.2022 when the matter was committed by the learned Sessions Court, he is not available and, as such, warrant of arrest was issued.

Petitioner is directed to hand over a copy of the revisional application upon Mr. Madhusudan Sur, learned advocate who ordinarily appears on behalf of the State. His appointment may be regularized by the concerned authorities and is directed to represent the case for the State. He is entitled to engage a junior of his choice. Learned advocate appearing for the petitioner undertakes that the petitioner would henceforth be present on each and every day when

the learned Trial Court fixes date for the purpose of SC Case No.71 of 2022, accordingly I direct that if the petitioner appears before the learned Sessions Judge, Malda, he may be allowed to continue on the same bail and bond on such terms and conditions as the learned Sessions Court deems fit and proper. The warrant of arrest so issued be stayed till 28th February, 2023. If the petitioner does not appear within the said time, learned Sessions Judge would be at liberty to issue directions under harsher process of law on and from 1st March, 2023. The petitioner shall once in a week meet with the Officer-in-Charge, Kaliachak Police Station till he appears before the learned Trial Court. Once he appears before the learned Trial Court such condition may be waived.

With the aforesaid observations, C.R.R. 4742 of 2022 is disposed of.
