Yusuf Mr. Prodyut Das ..for the State in WPA 28632 of 2025 Mr. Sourav Mondal ..for the respondent no.9 In re: WPA 28614 of 2025 This writ petition has been filed seeking issuance of a writ of mandamus inter alia restraining the respondents from dispossessing the petitioner no. 1 from the factory of the petitioner without affording an opportunity of hearing to the petitioner no.1.
Learned advocate appearing for the petitioners submits that by an order dated September 24, 2025 passed in WPA (P) 61 of 2021, the Hon'ble Division Bench of this Court has been pleased to grant liberty to the persons aggrieved by initiation of proceedings under Section 4C(5) of the West Bengal Land Reforms Act, 1955 to make appropriate representation before the authorities concerned. It is submitted that despite such liberty being reserved for the persons aggrieved, the respondent authorities have attempted to take possession of the property without hearing the petitioners.
Learned advocate appearing for the respondent State authorities invites the attention of this Court to the first paragraph of the said order dated September 24, 2025 and submits that the petitioners had even earlier failed to turn up despite issuance of notice under Section 4C(5) of the said Act of 1955. Attention is then invited the letter dated November 25, 2025 addressed to the lessor of the petitioners namely Karni Nirman Private Limited thereby urging the petitioners to comply with the directions passed by the Hon'ble Division Bench of this Court in WPA (P) 61 of 2021. It is submitted that despite such communication, no representation was received by the petitioners.
However, it is submitted by the learned advocate appearing for the State respondents on instructions that for compliance with principles of natural justice and fair
treatment, the petitioners can be heard on December 29, 2025 at 11 A.M. at the office of the respondent no.7. In such view of the matter, WPA 28614 of 2025 is disposed of by granting liberty to the petitioners to be present at the office of the Block Land and Land Reforms Officer, Tarakeswar on December 29, 2025 at 11 A.M. when the said officer shall afford an opportunity of hearing to the petitioners and shall pass appropriate orders.
It is made clear that the petitioners shall not be entitled to any adjournment and it would be ensured that the proceedings are not spilled over/extended beyond December 31, 2025 which is the deadline fixed by the Hon'ble Division Bench by the order dated September 24, 2025 passed in WPA (P) 61 of 2021. The proceedings must be completed by December 31, 2025 in terms of the mandate of the Hon'ble Division Bench as aforesaid. WPA 28614 of 2025 stand disposed of with the above observations. No costs.
In re: WPA 28632 of 2025 WPA 28632 of 2025 has been filed by Karni Nirman Private Limited who is the lessor of the petitioners in WPA 28614 of 2025. Since the relief prayed for by the petitioners in WPA 28632 of 2025 is similar to the one as prayed for by the petitioner in WPA 28614 of 2025 and the same proceeding governs both the parties, therefore, the petitioners in WPA 28632 of 2025 shall also be heard
by the Block Land and Land Reforms Officer, Tarakeswar (respondent no.7) on the same date i.e. December 29, 2025 at 11 A.M. without granting any adjournment. It is reiterated that the mandate of the Hon'ble Division Bench that the proceedings should not be continued beyond December 31, 2025 shall be strictly adhered to and no adjournment shall be granted.
WPA 28632 of 2025 stands disposed of. No costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
