Petitioners have challenged the orders dated 04.08.2023 and 22.11.2023 passed by the learned Additional Sessions Judge, Fast Track, 1st Court, Howrah in ST Case No.2754 of 2014 arising out of Howrah Women Police Station Case No.12 of 2013. I find from the records of the case that the learned trial court was pleased to issue proclamation and attachment after the warrant of arrest was not executed.

Learned advocate appearing for the petitioners undertakes that henceforth the petitioner would be regular before the court and was ill advised for not appearing.

Considering the fact that within close proximity the petitioners have approached, I direct that in case

the petitioners appear on or before 15th January, 2024 before the learned Additional Sessions Judge, Fast Track, 1st Court, Howrah in connection with the aforesaid case, learned trial court would recall the warrant, proclamation and attachment and allow the petitioners to continue on the same bail and bond with condition to be physically present before the court irrespective of whether any dates have been fixed, once in every week for a period of three months.

With the aforesaid observations, CRR 4753 of 2023 is disposed of.

All the parties shall act on the server copy of this order duly downloaded from the official website of this court.
