Petitioner(s) Mr. Soumya Basu Roy Chowdhury Mr. Abdul Aziz Mondal ... for the Petitioner(s) Mr. Bibaswan Bhattacharya Ms. Jonaki Saha ... for the State-respondent(s) Learned advocate for the petitioners submits that the petitioners are in custody for about ten months and there has been recovery of 495 bottles of phensedyl from the three persons including the present petitioners. Learned advocate for the State, on the other hand, opposes the prayer for bail and produces the case diary. However, the case diary do not reflect that there are antecedents of the present petitioners.

Having considered the period of detention and the time which will be required for concluding the trial, I am of the view that further detention of the petitioners are unwarranted.

Hence, the prayer for bail of the petitioners is Allowed.

Accordingly, the petitioners viz, Biswajit Roy @ Babulal and Sujit Mondal @ Kalu shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only) each, with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Judge, Special Court under NDPS Act, Krishnanagar, Nadia.

If on bail, the petitioners shall make themselves physically available on each and every date so fixed by the learned trial court and shall not leave the district of Nadia without prior intimation to the learned trial court. Accordingly, CRM(NDPS) 1668 of 2025 is allowed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
