The petitioner has been suspended since 2022 and he is only receiving subsistence allowance. The petitioner has applied before the DPSC, Murshidabad for reinstatement which has not been done till date. 2.

It is submitted that departmental proceeding has been initiated against the petitioner and the same has not been completed till date.

In those circumstances, this Court directs the DPSC, Murshidabad to complete the departmental proceedings against the petitioner positively within two months from date.

The respondents may in their discretion and in terms of the Rules take a decision on the further

continuation of suspension of the petitioner in the meantime.

It is expected that the respondents follow the Rules of procedure for conduct of the departmental proceedings. 6.

The writ petition is disposed of.

7.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
