Learned advocate for the State submits that the prosecution intends to examine 11 witnesses in support of its case, but, till date, charges have not been framed. The attention of the court is drawn to the order dated 13.08.2025 in respect of submission of charge-sheet. Having considered the same as also the prayer for bail which was earlier rejected of another co-accused in CRM (NDPS) 1130 of 2025 as also having regard to the quantum of contraband seized, I am of the view that the provisions of Sections 37 of the NDPS Act is attracted, as such, I am not inclined to enlarge the petitioner on bail.

Hence, the prayer for bail of the petitioner is Rejected.

However, the learned trial court is directed to expedite the progress of the case.

The petitioner would renew his prayer for bail after the evidence of the seizure list witnesses are over. Memo of Evidence submitted be kept with the record. Accordingly, CRM(NDPS) 1669 of 2025 is dismissed. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
