Sahidul Mallik v. The State Of West Bengal
13.12.2024 sdas Rejected C.R.M. (A) No. 4336 of 2024 In Re:- An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita in connection with Sankrail Police Station Case No. 140 of 2024 dated 18.02.2024 under Sections 341/325/307/354 of the Indian Penal Code.
And In Re : Sahidul Mallik ..... petitioner Mr. Sayan De Mr. Abhijit Mondal .....for the petitioner Mr. Ranabir Roy Chowdhury Mr. Rahul Ganguly ..... for the State 1.
Learned Counsel for the petitioner submits earlier there was a romantic relationship between the victim and his brother-in-law. Subsequently, the relationship soured. Earlier false cases had been registered against the petitioner by the victim which were subsequently withdrawn. Presently, victim has inflicted injuries on herself and falsely implicated the petitioner. Accordingly, he prays for anticipatory bail. 2.
Learned Counsel for the State opposes the prayer for anticipatory bail.
3.
We have considered the materials on record. We have examined the statement of the victim as well as injury report. These materials clearly show petitioner was responsible for causing injuries on the victim which do not appear to be
self-inflicted. In such view of the matter we are of the opinion this is not a fit case to grant anticipatory bail to the petitioner.
4. Accordingly, prayer for anticipatory bail is rejected. (Apurba Sinha Ray, J.) (Joymalya Bagchi, J.)
