The petitioner approached this Court with a grievance that the College authority did not allow him to join his duty.

The petitioner submitted that though he was appointed as a whole time assistant to the accountant at the relevant College, the College prevented him from discharging his duties.

Mr. Subhrangshu Panda, learned advocate for the College submitted that the petitioner did not attend the College voluntarily as he was not inclined to perform his duty as per the duty roster prepared by the College.

On January 5, 2024, this Court directed the petitioner to join his duty at the library in the annex

building of the College. The College was also directed to allow the petitioner to perform his duty as per the duty allotment roster.

Today, it has been submitted by Mr. Sabyasachi Mukherjee, learned advocate appearing for the petitioner that the petitioner has joined his duty as aforesaid. He, however, submitted that the petitioner is not getting any incremental benefit and his pay has not been fixed properly.

I am of the view that the petitioner being a temporary employee engaged on a contractual basis, as a matter of right, cannot claim any increment. However, he will be at liberty to make a representation before the College Authority for ventilating his grievance with regard to his salary. Nothing further remains to be decided in the present writ petition. Accordingly, W.P.A. 27833 of 2023 is disposed of.
