State has submitted a report in the form of an affidavit. The same has already been served on the learned advocate appearing on behalf of the petitioner. Petitioner approached this court being aggrieved by the action of the police authorities. However, the report so submitted reflects that information was furnished to the learned CJM, Uttar Dinajpur and thereafter steps were taken for attachment of the property. If inconveniences are faced for attachment of the property pursuant to a direction of the court then the proper course of action would be for the petitioner to approach the revisional court in respect of legality or illegality of the order so passed by the learned Magistrate. This court under Article 226 of the Constitution of India will never interfere in respect of
a step taken by an official under particular statute. Thus, petitioner if so advised would approach the revisional court. No further order needs to be passed in the present writ petition.
Accordingly, WPA 29082 of is disposed of.
Report in the form of affidavit filed by the State be kept with the record.
