The petitioner claims of alleged inaction on the part of the Garhbeta Police in investigating into the FIR No.579/2022 dated 29th September, 2022 under Sections 365, 379, 376D of the IPC.

Report in the form of instructions dated 24th January, 2023 issued by the Officer-in-Charge, Garhbeta Police Station, Paschim Medinipur addressed to the learned State Advocate is taken on record.

This Court notes that the accused persons, in a FIR in respect of non-bailable offences were only called and statements were recorded. The accused were not taken into custody. Be that as it may, it appears that final report being Garhbeta PS FRT No.679/22 dated 27th November, 2022 has been filed in the matter.

A prayer has also been made by the IO, for prosecution of the petitioner under Sections 181/211 of the IPC. The matter has been fixed on 14th March, 2023 for appearance of the petitioner before the Court below. Let a copy of the report of the police be given to the counsel for the petitioner.

The petitioner may take steps as she may be advised in accordance with law.

With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.
