Report submitted by the State is taken on record. The petitioner alleges that the private respondents have raised unauthorized construction without obtaining sanction from the concerned Panchayat. The petitioner submitted a representation in this regard before the concerned authority on 26th November, 2024 and seeks consideration of the same.

It appears from the report submitted by the State that pursuant to the representation submitted by the petitioner, the Panchayat Pradhan declared the construction unauthorized after granting opportunity to both the parties of being heard.

The Sub-Divisional Officer, Canning, South 24 Parganas, being the 3rd respondent herein, has undertaken to take necessary steps in terms of the West Bengal Panchayat Act in this regard.

In view of the above, the 3rd respondent is directed to take necessary steps for demolition of the unauthorized construction within four weeks from the date of

communication of this order. He is at liberty to take police assistance for the purpose, if required.

The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
