Report submitted by the Block Development Officer, Basirhat-II Development Block, North 24-Parganas is taken on record.

It appears from the report that the petitioner is a habitual absentee. The petitioner was absent from his duty for 262 days since June 26, 2020, unauthorisedly. Communications and show cause notices were issued. The Pradhan, Kholapota Gram Panchayat also intimated the Block Development Officer that the petitioner was irregular in his duties. From September 9, 2022 the petitioner joined his duty for a brief while and he has been once again absent since November 23, 2022, without any intimation and reason. The Block Development Officer has further stated that the petitioner was free to join his duties.

As the authorities have specifically stated in the report that the petitioner may join his service provided he discharges his duties diligently, the allegations of the petitioner are not accepted. Nothing further remains to be decided in the writ petition.

The petitioner is at liberty to take proper steps on the basis of the observations made hereinabove. However, this order shall not preclude the authorities from taking steps against the petitioner with regard to the petitioner's unauthorized absence in the past. All such action shall be strictly in accordance with law. The writ petition is, thus, disposed of.

There shall be no order as to costs.

Parties are to act on the basis of the server copy of this order.
