The petitioner is the wife of the private respondent who is an employee of a school. The relationship between the petitioner and her husband is acrimonious.

The petitioner apprehends that if the husband retires without incorporating the name of the petitioner and her minor daughter in his service records, then she and her daughter will be highly prejudiced. A representation has been made to the DI of Schools requesting attachment of the petitioner's salary.

On a perusal of the representation it does not appear that the petitioner has approached the authority praying for leave to incorporate her name in the service book of the employee.

In view of the above, the instant writ petition is disposed of with the observation that it will be open for the petitioner to apply before the

concerned authority seeking incorporation of her name in her husband's service book.

In the event any such representation is made, the same shall be considered by the concerned respondent in accordance with law at the earliest. 5.

If required, an opportunity of hearing shall be granted to the petitioner and the private respondent prior to making any change in the service book of the employee.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

Certified copy of this order, if applied for, shall be made available to the parties.
