Affidavit of service filed on behalf of the petitioner is taken on record.

By the present writ petition the petitioner seeks direction upon the respondent authorities to grant family pension in favour of the petitioner.

The petitioner contends that her father, late Paresh Chandra Maity, was an Assistant Teacher in Vairabdari Primary School, Post Office- Vairabdari, District-Purba Medinipur. The father of the petitioner retired from service on superannuation on 31st October, 1982 and died on 12th September, 1998. During his lifetime the father of the petitioner was receiving monthly pension. The mother of the petitioner died on 22nd August, 2018. The husband of the petitioner died on 30th April, 2002. The petitioner is the widowed daughter of the deceased employee. On 6th November, 2025 the petitioner made a representation before the respondent no.4, District Inspector of Schools (PE), Purba Medinipur for grant

of family pension. However, the same is still pending consideration. Hence this writ petition.

Mr. Dilip Kumar Sadhu, learned advocate for the petitioner submits that the matter may be relegated to the appropriate authority for considering the representation of the petitioner in accordance with law.

None appears on behalf of the State.

Mr. Razzak Hossain, learned advocate, who usually appears for the State, is requested to appear in this matter. Let his appointment be regularised.

The petitioner is directed to hand over a copy of the writ petition along with the annexures to Mr. Razzak Hossain, learned advocate for the State.

Mr. Hossain, learned advocate for the State leaves the matter to the discretion of the Court.

In view of the submissions advanced, respondent no.4, District Inspector of Schools (PE), Purba Medinipur is directed to consider the representation of the petitioner dated 6th November, 2025 and dispose of the same by passing a reasoned order in accordance with law upon notice to the petitioner and other legal heirs within a period of eight weeks from the date of communication of this order.

10. Learned Advocate for the Petitioner is directed to communicate this order to the respondent no.4, District Inspector of Schools (PE), Purba Medinipur for necessary compliance.

With the aforesaid directions, the writ petition being WPA 28664 of 2025 is disposed of.

Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted.

13.

Interim order, if any, stands vacated.

14.

All connected applications, if any, stand disposed of. 15.

There shall be no order as to costs.

16.

All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.

17.

Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
