1. Appellants were not parties before the Hon'ble Single Judge. They contend they are necessary parties and were not heard by the said Judge.

2. By the impugned order the grievances of the respondent no.1/writ petitioner with regard to illegal construction was remanded before the Howrah Municipal Corporation. The Corporation was directed to hold spot inspection and after giving an opportunity of hearing to all necessary parties conclude the proceeding initiated by it. No final decision was taken.

3. Nobody appears for the appellants. No application for leave to appeal has also been filed.

4. Accordingly, the appeal is dismissed for default. (Supratim Bhattacharya, J.) (Joymalya Bagchi, J.)
