Kausik (Rejected) CRM (NDPS) 1671 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with NCB Crime No. 04/NCB/Kol/2025 under Sections 8(c)/21(c)/23/25/27A/29 of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that petitioner has been implicated on the basis of statement of co-accused and is in custody for 99 days. According to the petitioner, complaint has been filed before the jurisdictional Court and charges have been framed. As such further detention of the petitioner is unwarranted.

Learned advocate for the NCB on the other hand produces the materials which reflect that the main foundation for implicating the petitioner is the CDR which reflects the communication between the petitioner and the principal accused as well as the petitioner and another co-accused.

Having considered the place from where seizure has been effected and the quantity of Heroin which has been seized is of commercial quantity, I am of the opinion, at this stage, this is not a fit case for granting bail.

Accordingly, CRM (NDPS) 1671 of 2025 is dismissed. Petitioner will renew his prayer for bail after the evidence of the seizure list witnesses are over. Learned Trial Court would prepone the examination of the seizure list witnesses preferably within a period of 4 months from the next date so fixed.

Report submitted by the NCB be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
