The writ petition has been called repeatedly but none represents the petitioner or the applicant in CAN 1 of 2025. The connected application along with writ petition has been preferred for substitution. However, till date, none represented the applicant to present his case.
The subject matter of the writ petition relates to an information furnished with the Officer-inCharge, Deganga Police Station. The summary of the complaint is that the private respondents are trying to criminally trespass, illegally trying to get possession so far as the land-in-issue is concerned.
I find from the records that the information which was furnished to the local police station was
dated 16.11.2023. The report which has been submitted on behalf of the State reflects that police authorities are well aware regarding the nature of the dispute and of the fact that a title suit at the relevant point of time was pending being T.S. No.982 of 1994. Having considered that the subject matter of the writ petition relates to incidents complained of on 16.11.2023 and almost 21 months have passed since then, I direct that if the petitioner is faced with inconveniences, petitioner under the changed circumstances will approach the local police station which would address the issue within the framework of law.
With the aforesaid observations, WPA 27790 of 2023 along with CAN 1 of 2025 is disposed of. Report so submitted be kept with the record.
