The writ petition is disposed of with a direction upon the Chief Engineer, Sundarban Development Board to dispose of the representation of the petitioner dated December 16, 2022 which is at Page-32 of the writ petition. The allegation is that without any permission and without paying any compensation to the petitioner, who claims to be the owner of Plot No.976 of Mouza-Mathurapur, the Sundarban Development authority had constructed a road thereon.

This Court is not entering into the allegation made in the writ petition. The authority shall dispose of the issue upon granting an opportunity of hearing to the petitioner and all other concerned persons including the contractors. A reasoned order shall be passed and communicated.

The entire exercise shall be completed within a period of three months from date of communication of this order. As no affidavit-in-opposition is called for, the allegations made in the writ petition are deemed to be denied.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
