Mr. Arijit Ganguly Mr. Sanjib Dan .....For the State Learned advocate appearing for the petitioner submits that the petitioner was arrested in connection with N.D.P.S. Case No.59 of 2017 arising out of Haripal Police Station Case No.225 of 2017. During the said period of his custody he was shown in custody in number of cases. The petitioner was also shown arrested in connection with Singur Police Station Case No.311 of 2017 dated 08.08.2017. According to the learned advocate, the petitioner was granted bail on 5th February, 2018 in connection with Singur Police Station Case No.311 of 2017. The petitioner continued to be in custody in NDPS case which was initiated by Haripal Police Station and finally he was acquitted of the charges from the said case on 9th September, 2021. The warrant of arrest was issued in the year 2019 in connection with the present case being, Singur Police Station Case No.311 of 2017.

Petitioner is directed to serve a copy of the revisional application upon Mr. Mukherjee, learned Public Prosecutor appearing for the State. Having considered the series of events as submitted by the petitioner, I direct the learned A.C.J.M., Chandannagar to assess from the records of Singur Police Station Case No.311 of 2017 whether the petitioner was granted bail in connection with the said case. In case the petitioner was granted bail and he surrenders by 17th February, 2023, the learned A.C.J.M., Chandannagar will allow the petitioner to continue on the same bail and bond subject to the condition that he would meet with the Officer-in-Charge/Inspector-in-Charge, Singur Police Station once in every 10 days for the next six months.

The execution of warrant of arrest so far as the present petitioner is concerned be stayed till 19th February, 2023. In case the petitioner does not appear within the aforesaid dates, on 20th February, 2023, the learned A.C.J.M., Chandannagar would shift to the next harsher process of law. Accordingly, C.R.R. 4753 of 2022 is disposed of. Learned A.C.J.M., Chandannagar is directed to act on the server copy of this order downloaded from the official website of this Hon'ble Court.
