1. This application has been filed with a prayer for expeditious disposal of the proceeding pending before the learned Judicial Magistrate, 2nd Court, Barasat, 24-Parganas (North) pertaining to G.R. Case No. 593 of 2022 arising out of Deganga Police Station Case No0. 106 of 2022 dated 12.02.2022 under Sections 341/325/34/307 of the Indian Penal Code.
2. It is submitted by the learned advocate appearing for the petitioner that present petitioner has been falsely implicated in this case.
3. Learned advocate representing the State/respondent, on the other hand, submits that the status report of the said proceeding reveals that the next date is fixed for hearing.
Charge has not yet been framed and the next date is fixed on 26th February, 2026.
4. Having heard both the learned advocates and on perusal of the record, it transpires that this application for expeditious disposal is pending itself before this Court since 2023 and it is quite astonishingly that as of now, the charge has not yet been framed, when the last date was fixed on 24th September, 2024.
5. It is undisputed that pendency of this case is causing to suffer physical and mental agony. Hence the learned Court is directed to come to a logical conclusion on the date so fixed.
6. It is further made clear that in the event any such situation arises, which compels the Court not to hear the matter, the same should be heard within the period of one month from such date positively without granting any unnecessary adjournment or either of the parties. The learned Court is further directed to expedite the hearing of the case.
7. With the above observation, the revisional application stands disposed of.
8. Let a copy of this order be communicated to the learned Court below for intimation and necessary action.
9. Urgent photostat certified copy of the order, if applied for, be given to the parties upon complying with all legal formalities. (Chaitali Chatterjee [Das], J.)
