Petitioners do not intend to proceed with the revisional application so far as the present petitioner no.4 is concerned. Accordingly, the prayer advanced in the revisional application for Sajada Parveen @ Chandni, wife of Md. Kaiser is dismissed as not pressed.

So far as the rest of the petitioners are concerned, namely, Syed Arshad @ Muhammed Arshad, Tasin alieas Tasin Alam Tanseen Alam have approached the court as the warrant of arrest has been issued against them.

Learned advocate for the petitioners draws the attention of this court to the fact that the petitioners were earlier enjoying liberty and on two occasions they did not appear, as such warrant of arrest has been issued against them.

Learned advocate for the petitioners submits that the aforesaid three petitioners would henceforth appear before the

court on each and every date so fixed and will abide by the terms so imposed by the learned trial court.

Accordingly, if the petitioners named above appear and surrender before the court, the learned trial court will only assess to the limited extent as to whether they were earlier granted bail. In case they were earlier on bail they should be allowed to continue on the same bail and bond after they surrender by 29th February, 2024.

If the petitioners do not surrender by 29th February, 2024 in that case the learned trial court on 1st March, 2024 would resort to harsher process of law by adhering to Sections 82/83 of the Code of Criminal Procedure.

With the aforesaid observations, the revisional application being CRR 4764 of 2023 is disposed of.

Accordingly, the application being CRAN 1 of 2023 is disposed of.

Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
