1. The present revisional application was preferred challenging the continuance of the proceedings arising out of the Dakshineshwar Police Station case no. 259 of 2022 dated 17th November 2022, which was registered under Sections 498A/34 of the IPC.

2. Earlier, this Court directed the State to produce the case diary and submit a progress report before this Court. The progress report reflects that the charge sheet has been submitted on or before 28th December 2022 before the Learned Additional Chief Judicial Magistrate, Barrackpore and the next date is fixed on 28th December 2023.

3. Let the memorandum of evidence submitted by the State be kept with the record.

4. In view of change of circumstances I am of the opinion that the learned advocate for the petitioners should be at liberty to prefer a fresh application after receipt of the documents under Section 207 of the Cr.P.C.

5. With the above directions, the revisional application being CRR 4759 of 2023 is disposed of.

6. Pending application, if any, is also disposed of.

7. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court at Calcutta.
