Affidavit of service filed in Court today is taken on record. None appears on behalf of the opposite parties despite service.

This revisional application seeks expeditious disposal of an application under Order XXI Rule 97 read with Section 151 of the Code of Civil Procedure, 1908 and Rule 208 of the Civil Rules and Orders praying for police help filed by the petitioner/decree holder.

Learned Advocate appearing for the petitioner submits that the petitioner filed a suit for eviction of the opposite parties which was decreed on May 23, 2017. The said decree has been put into execution by initiating Title Execution Case No. 10 of 2017 before the learned Civil Judge (Senior Division), 7th Court at Alipore, South 24-Parganas. 4.

In the said execution case, the petitioner has filed an application praying for police help as aforesaid, which is pending since 2018. The same has been registered as Misc. Case No. 2 of 2018.

Having heard the learned Advocate appearing for the petitioner and having considered the material-on-record, this revisional application is disposed of by requesting the learned Civil Judge (Senior Division), 7th Court at Alipore, South 24Parganas to dispose of the petitioner's application under Order XXI Rule 97 of the Code of Civil Procedure read with Rule 208 of the Civil Rules and Orders praying for police help which has been registered as Misc. Case No. 2 of 2018 as expeditiously as possible and preferably within a period two months from the next date fixed without granting any unnecessary adjournment to either of the parties, unless there is any order of stay of the execution case granted in the meantime.

C.O. 4381 of 2025 stands disposed of. No costs.

7. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
