Versus

The State of West Bengal & Ors.

Mr. Lal Ratan Mondal ..for the Petitioner Affidavit of service filed by the petitioner is taken on record.

None appears for the respondents despite service. Learned counsel for the petitioner submits that in a title suit filed by the petitioner against the private respondents, the learned civil court granted an order of ad interim injunction restraining the private respondents from changing the nature and character of the suit pond. The private respondents in violation of the said order are trying to change the nature and character of the pond. The petitioner seeks police assistance to stop such violation. Since an order passed by the civil court has been allegedly violated by the private respondent, the petitioner is at liberty to approach the appropriate forum for redressal of his grievance. He also is at liberty to seek implementation of the order of adinterim injunction before the appropriate court.

In the meantime the police authority shall keep strict vigil in the area in order to avoid any untoward

incident and to ensure maintenance of peace and tranquility.

The writ petition is accordingly disposed of. There shall, however, be no order as to costs. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
