Ms. Arpita Saha ....for the petitioner Ms. Neelam Singh ........ for the state Affidavit of service filed on behalf of the petitioner is taken on record.

In addition thereto, in terms of order dated 11th December, learned advocate representing the petitioner attempted to serve notice upon learned advocate representing State respondents but service could not be effected since learned advocate for the State respondents was not found available at Bar.

Since no one is representing State respondents today, Ms. Neelam Singh, learned advocate who is present in Court and usually appears on behalf of the State respondents, is requested to enter appearance on behalf of the State respondents. Let engagement of Ms. Neelam Singh be regularized by the office of the learned Government Pleader.

Petitioner is a retired Assistant Teacher, who superannuated on 31st December, 2020.

After superannuation of petitioner, Pension Payment Order was issued on 16th February, 2022 releasing retiral dues in favour of the petitioner. Petitioner claims interest on gratuity due to delayed payment.

Accordingly, the Director of Pension Provident Fund and Group Insurance and the concerned Treasury Officer are directed to pay interest at the rate of 8% per annum to the petitioner on gratuity from the date following the date of retirement of the petitioner till the date of release of gratuity, within a period of eight weeks from the date of communication of this order.

Since no affidavit is called for, the allegations contained in the writ petition are deemed not to have been admitted.

With the above observation, the writ petition stands disposed of.

There shall be no order as to costs.
