The Court has heard Mr. Chatterjee at length on the report of the CID, West Bengal dated 14th January, 2023. It appears that the charge-sheet has been filed under section 302 read with section 34 of the Indian Penal Code.

This Court cannot find any serious infirmity with investigation or the conclusion arrived at by the Investigating Officer. 24 persons have been named as accused in the charge-sheet. All 24 persons are, however, on bail.

Learned counsel for the petitioner submits that the matter requires further investigation to probe into the role of the girl friend of the deceased. He may take appropriate steps before the ACJM concerned. 4.

This Court is, however, concerned about the fact that all 24 accused in case of public lynching have been enlarged on bail.

In the circumstances above, the petitioner as well as State shall be entitled to apply for cancellation of bail in the event the petitioner so desirous. 6.

The writ petition stands disposed of.
