Petitioner is aggrieved by the fact that in spite of informing the police authorities, no action has been taken against the private respondents. Although he has been adhering to the provisions of law for the construction work being carried on.

The private respondents have obstructed and stopped the construction work.

Learned advocate for the State has submitted a report. The report reflects that on the basis of the written complaint, the police authorities have registered Sonarpur PS. Case No. 1647 of 2024 against the private respondents.

Proceedings have also been drawn up by the police authorities under Section 126 of the BNSS.

So far as other issues relating to construction is concerned, the petitioner and the respondents are already before the civil Court and it would be for the civil Court to take a decision in respect of the construction work. As the police authorities have already taken steps, I am of the view that further interference is uncalled for in this Court.

However, the police authorities would continue to keep strict vigil in view of the strained relationship between the petitioner and the private respondents. With the above observations, WPA 29220 of 2024 is disposed of.

Report so submitted be kept with the records. Copy of the report be handed over to the learned advocate for the petitioner.

There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this court.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
