Learned advocate appearing for the petitioners submits that the petitioners are innocent of the charges as the petitioner nos. 1 and 3 are driver of the vehicles and petitioner no.2 happens to be a passenger. All of them are in custody for more than 1 year 1 month and the quantum of recovery in the present case is 120 kgs. of ganja. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that three other accused persons are still absconding. As such there is no progress in the case.

Having considered the quantum of seizure, at this stage, I am not inclined to release the petitioners on bail. As such, the prayer for bail of the petitioners is rejected.

Learned Trial Court would take steps for splitting up the trial preferably within a period of 60 days from the date of communication of this order.

Petitioners would be at liberty to approach this Court after the evidence of the seizure list witnesses is over. The application for bail, being CRM (NDPS) 1674 of 2025, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
