The contention of the petitioners is that they are entitled to annual scholarship under the Kanyashree Youjna Prokolpo. The same was not granted to them on an erroneous assumption that the petitioners were married.

In the absence of the policy framed by the government under the Kanyashree Youjna Prokolpo, it is not possible for the Court to pass the orders, as prayed for.

The petitioners claim that they are both entitled to annual scholarship as they are unmarried college students.

The petitioners are granted liberty to file individual representations before the Sub Divisional

Officer, Chanchal Sub Division, ventilating their grievances. If such applications are filed, the same shall be disposed of in accordance with law upon granting an opportunity of hearing to the petitioners. The petitioner shall produce all documents in support of their claims and contentions made in the writ petition. Further documents in support of the fact that they are continuing to pursue their studies in Gour College, Malda shall also be filed.

This Court has not gone into the merits of the issues involved.

The Sub Divisional Officer, Chanchal Sub Division shall dispose of the individual representations of the petitioners, independently on their own merits and shall pass two reasoned orders. The orders shall be communicated to the petitioners within a period of six weeks from the date of receipt of the representation of each of the petitioner. If the petitioners are otherwise found to be eligible for grant of the beneficial scheme framed by the state for social and educational upliftment of the female population, such benefits should be extended to the petitioners, subject to compliance of all other eligibility criteria. This writ petition is disposed of.

There will be, however, no order as to costs. All parties are directed to act server copy of this order.
