And In the matter of : Tapan Jana @ Swapan Jana & anr. ...... petitioners Mr. Abhinaba Mukherjee ....for the petitioners Mr. Ranadeb Sengupta ....for the State There is a Title Suit pending.

Apparently, an incident of assault took place involving the injured and the petitioners amongst others.

Injured suffered two fractures. Injured named both the petitioners before us as the assailants causing such injuries. Notwithstanding the fact that, police filed charge-sheet, given the gravity of the offence and the involvement of the petitioners therein, we are unable to grant anticipatory bail to the petitioners.

This application for anticipatory bail is, thus, rejected. CRM(A) 5533 of 2023 is disposed of.
