Mr. Anirban Chakraborty ...for the petitioner Affidavit of service has been filed today. In addition to the affidavit of service a notice dated 19th December, 2024 was attempted to be served upon the learned advocate representing the State-respondents in terms of the previous order dated 12th December, 2024 but notice could not be effected since the learned advocate for the State-respondents was out of station. Petitioner being an approved clerk retired on superannuation on 30th April, 2019.

After superannuation of the petitioner, 1st Pension Payment Order was issued on 24th June, 2019 thereby releasing retiral dues including pension in favour of the petitioner. Due to revision of pay as per ROPA 2019 revised Pension Payment Order was issued on 10th June, 2021. Petitioner prays for interest on revised gratuity as per revised Pension Payment Order due to delayed payment.

Accordingly, the Director of Pension, Provident Fund and Group Insurance, West Bengal and the

concerned Treasury Officer are directed to pay interest at the rate of 8% per annum to the petitioner on revised gratuity as per revised Pension Payment Order from 14th February, 2020 till the date of actual disbursement of revised gratuity amount in favour of the petitioner, within a period of 8 (eight) weeks from the date of communication of this order.

Since no affidavit is called for, the allegations contained in the writ petition are deemed not to have been admitted.

With the above observation, the writ petition stands disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
