Learned advocate representing the petitioner was directed to serve notice upon the learned advocate representing the State-respondents. Today, notice dated 19th December, 2024 is placed before this Court and taken on record wherefrom it appears that learned advocate for the State-respondents was informed on 19th December, 2024. Today, also State-respondents are not represented.

The petitioner was an Assistant Teacher, who retired on superannuation on 29th February, 2020. After superannuation of the petitioner, Pension Payment Order was issued on 6th October, 2020 thereby releasing retiral dues including pension. The petitioner prays for release of interest on gratuity due to delayed payment.

Accordingly, the Director of Pension, Provident Fund and Group Insurance, West Bengal and the

concerned Treasury Officer are directed to release interest at the rate of 8% per annum to the petitioner on gratuity from the date following the date of superannuation of the petitioner till the date of release of the same by 8 (eight) weeks from the date of communication of this order.

Since no affidavit is called for, the allegations contained in the writ petition are deemed not to have been admitted.

With the above observation, the writ petition stands disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
