Pleader Mr. Ziaul Haque ...for the State The petitioner claims to have purchased the Plot No. 378, Khatian No. 7801 within Mouza Palashipara, J.L. No. 42 measuring an area of 22 decimals. The petitioner states that his name has been recorded in the L.R. record of rights.
The petitioner has submitted a representation before the Block Land & Land Reforms Officer, Tehatta - II Block, Palashipara, Nadia. In the said representation it has been specifically stated that the private respondents herein have filed a Title Suit being No. 61 of 2023 against the wife of the petitioner and others and also filed an application under Order 39 Rule 1 and 2 of the Code of Civil Procedure praying for temporary injunction. It has also been specifically stated in the said representation that the application for temporary injunction was rejected on
contest. The petitioner has further stated in the said representation that after rejection of the injunction petition the aforesaid persons i.e. the private respondents herein have hung up a board on his raiyati land stating that the land is a Government land and the board was hung up on the petitioner's land with an intention to grab his property by breaking boundary wall forcefully and illegally without any care of the law of the land. The petitioner has filed the instant writ petition praying for an order directing the respondents to remove the board from the land of the petitioner forthwith and to pass an interim order of injunction restraining the respondent authorities from disturbing the petitioner's peaceful possession and occupation of the land till the disposal of the application.
The allegations made in the representation forms the basis of the writ petition. After going through the statements made in the said representation it appears that there is a dispute with regard to possession of the property in question between the private parties i.e. the petitioner and the private respondents. A notice board stating it to be a Government land is also alleged to have been affixed by the private respondents on the property of the petitioner.

Pursuant to the order dated 8th January, 2026 the Assistant Director and Block Land and Land Reforms Officer, Tehatta-II, Palashipara, Nadia has filed the report dated 9th January, 2026 which is taken on record. It has been stated in the said report that a portion of Plot No. 378 has been acquired. The petitioner claims that the possession of his rayaiti property is being disturbed by the private respondents.
For such reason, this Court is not inclined to grant any relief to the petitioner in this writ petition. WPA 29247 of 2024 stands dismissed.
It is, however, made clear that this order shall not prevent the petitioner from approaching the proper forum for appropriate reliefs in accordance with law.
There shall be however no order as to costs.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
