Petitioner(s) Mr. Sandip Chakraborty Mr. Kaustav Das ... for the Petitioner(s) Mr. Ranabir Roy Chowdhury Mr. Anindya Sundar Chatterjee ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitner is in custody for seven months and the subjectmatter of the case relates to alleged recovery of 309 gm of brown colour substance from three other accused persons. According to the learned advocate, so far as the present petitioner is concerned, there was no recovery of contraband but the prosecution has alleged that there was recovery of Rs. 18,27,500/- cash money from the house of the present petitioner.

Learned advocate for the State, on the other hand, opposes the prayer for bail and produces the case diary. I have considered the case diary which reflects that the seizures were effected on August, 2025. Initially, it was thought that there may be an error on the part of the

investigating officer, but, consistently, series of seizure list have been found to be of 19.08.2025. The present case was registered on 08.09.2025 and the petitioner was arrested on 12.09.2025.

Having considered that either there were questionable events or there was dereliction on the part of the investigating officer, I am of the opinion that the subject-matter before this court is restricted to bail, as such, without entering into the merits of the case, I am inclined to enlarge the petitioner on bail.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Sultan Sk. shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Judge, Special Courtcum-learned ADJ, 4th Court, Malda. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court and shall not leave the district of Malda without prior intimation to the learned Special Court. Accordingly, CRM (NDPS) 1680 of 2025 is allowed. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
