No. 29 CHC Rejected C.R.M.(A) 5537 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Manikchak Police Station Case No. 610 of 2023 dated 04.08.2023 under Sections 363/365/506/376(n)/34 of the Indian Penal Code and Section 6 of the POCSO Act.

...... petitioners Mr. Abhijit Karmakar, Mr. Arup Kumar Bhowmick ....for the petitioners Mr. Pinak Kumar Mitra ....for the State Victim recorded her statement under Section 164 of the Criminal Procedure Code where she identifies one person who raped her.

Petitioners before us apparently were involved trying to arrange a marriage between the victim and the principal accused.

Considering the materials in the Case Diary and particularly, the statement of the victim recorded under Section 164 of the Criminal Procedure Code and her age, we are unable to grant anticipatory bail to the petitioners. This application for anticipatory bail is, thus, rejected. CRM(A) 5537 of 2023 is disposed of.
